PPC: A Complete Guide For A New Law Firm

A Quick Overview of the American Legal System

The American legal system is a complex system that is based on the principles of federalism, separation of powers, and the rule of law. It is made up of several layers of courts, each with its own jurisdiction and responsibilities. If you’re facing legal issues, it’s wise to consult a lawyer. Trying to navigate the system without experience and legal education can be especially difficult.

Of course, you can learn about many legal issues online. However, the language is often complex, and you may misunderstand something. Still, if you’re facing legal issues, it’s not a bad idea to spend some time learning the basic lay of the land. This way, when it comes time to hire a lawyer, you’ll be in a better position to understand how everything works.

That said, if you’re especially busy, say raising a family or pursuing your career, you may want to leave most of the burden to your attorney. When looking for a lawyer, however, it’s crucial to find someone who specializes in cases similar to yours.

For example, if you’ve recently suffered sexual harassment with a boss offering you a promotion or bonus in exchange for sexual favors, you’ll want to seek the advice of a quid pro quo lawyer. They will know how to gather evidence and pursue a case against the harasser(s). If you’ve been in a traffic accident, on the other hand, you’ll want to find a traffic law attorney.

With that said, let’s look at the basics of the American legal system.

Dual Courts, Separated Powers

The United States actually has a dual court system, consisting of federal courts and state courts. Which court someone ends up in will depend on the nature of their (alleged) crime. The federal court system is responsible for interpreting the United States Constitution, federal laws, and resolving disputes between states.

The state court system is responsible for interpreting state laws and resolving disputes between individuals and businesses within the state. In practice, most cases are tried at the state level.

The Supreme Court Explained

At the federal level, the Supreme Court is the highest court in the land, and its decisions are binding on all lower courts. The Supreme Court hears cases that involve significant constitutional issues, such as civil rights, federalism, and the balance of power between the federal and state governments.

Below the Supreme Court, there are the Circuit Courts of Appeals, which are responsible for hearing appeals from the lower federal courts in their respective geographic regions. There are also District Courts, which are responsible for hearing both criminal and civil cases.

Here’s How State Courts Work

The state court system is generally structured similarly to the federal court system, with a hierarchy of courts that hear cases at different levels. Each state has its own system of trial and appellate courts, with the highest court typically referred to as the state supreme court.

In addition to the court system, the American legal system is also governed by a set of laws and legal principles that are outlined in the United States Constitution, federal and state statutes, and common law.

In criminal cases, the government brings charges against an individual or entity, and the burden of proof is on the government to prove guilt beyond a reasonable doubt. In civil cases, the plaintiff brings a lawsuit against the defendant, seeking a legal remedy for harm that was suffered.

Protect Yourself by Studying up on Law and Hiring a Lawyer

Ultimately, the American legal system is designed to ensure that justice is served, that individual rights are protected, and that disputes are resolved in a fair and impartial manner. Still, the outcome of your case may largely depend on the skill of the lawyers you have access to. Especially with complicated cases, like sexual harassment, lawyers can play an outsized role.
