Following the DOL’s approval, the employer must submit Form I-129, Petition for Nonimmigrant Worker, to the U.S. Citizenship and Immigration Services (USCIS). Once approved, the prospective foreign worker can apply for the H2B visa at a U.S embassy or consulate in their home country. An interview at the embassy or consulate, typically scheduled post-USCIS petition approval, marks the final step in the process.
